PARKVIEW EXECUTIVE TOWNHOMES HOMEOWNERS ASSOCIATION, INC.

 

WHEREAS, the Property Owner intends to construct, renovate, improve, alter, repair, or develop a property located within Parkview Executive Townhomes;

WHEREAS, the Homeowners Association seeks to protect the safety, security, cleanliness, peace, order, infrastructure, and welfare of all residents;

NOW THEREFORE, the undersigned Property Owner and Contractor agree to comply with the following Construction Rules and Regulations:

SECTION 1. HOA APPROVAL REQUIREMENT

  1. No construction, renovation, repair, demolition, fencing, extension, excavation, or structural modification shall commence without prior HOA approval.

  2. The homeowner shall submit the following documents before construction begins:
    a. Copy of Building Permit issued by the Local Government Unit;
    b. Approved Building Plans;
    c. Contractor Information Sheet;
    d. Worker Registration List;
    e. Construction Schedule;
    f. Emergency Contact Information;
    g. Proof of payment of Construction Bond;
    h. Any other documents required by the HOA.

  3. HOA approval shall not exempt the homeowner from complying with applicable laws, building codes, permits, and government regulations.

SECTION 2. CONSTRUCTION HOURS

  1. Construction activities shall only be allowed from:
    Monday to Saturday
    8:00 AM to 5:00 PM

  2. No construction work shall be conducted on:
    • Sundays
    • Legal Holidays
    • HOA-declared special days

            unless prior written approval is obtained from the HOA.

  1. Activities prohibited outside construction hours include:
    • Hammering
    • Welding
    • Grinding
    • Drilling
    • Concrete pouring
    • Delivery of materials
    • Use of power tools
    • Any activity generating excessive noise

SECTION 3. WORKER REGISTRATION AND IDENTIFICATION

  1. All workers, laborers, subcontractors, foremen, engineers, architects, suppliers, and contractors must be registered with the HOA.

  2. The homeowner shall submit:
    • Full Name
    • Address
    • Contact Number
    • Government-issued ID

          for every worker entering the subdivision.

  1. Workers may be denied entry if:
    • Not registered
    • Refuse identification
    • Have been previously banned by the HOA
    • Violate subdivision rules

  2. HOA-issued identification cards or permits must be worn while inside the subdivision whenever required by the HOA.

SECTION 4. SECURITY RULES

  1. Workers shall only enter and exit through designated subdivision gates.

  2. Workers shall remain within the construction site and shall not loiter, roam, or gather in common areas.

  3. Workers shall not use:
    • Swimming Pool
    • Clubhouse
    • Parks
    • Playground
    • Basketball Court
    • Common Areas

          unless specifically authorized by the HOA.

  1. Security personnel may inspect vehicles entering or leaving the subdivision.

  2. Security personnel may refuse entry to individuals violating HOA regulations.

SECTION 5. PROHIBITED ACTIVITIES

The following activities are strictly prohibited:

  1. Sleeping or residing at the construction site.

  2. Drinking alcoholic beverages.

  3. Gambling.

  4. Illegal drug use.

  5. Fighting or disorderly conduct.

  6. Loud music.

  7. Videoke.

  8. Harassment of residents.

  9. Trespassing onto neighboring properties.

  10. Public urination or defecation.

  11. Cooking on roads or common areas.

  12. Open burning of garbage or construction waste.

SECTION 6. VEHICLE AND DELIVERY RESTRICTIONS

  1. Vehicles exceeding six (6) wheels shall not be allowed without prior HOA approval.

  2. Delivery vehicles shall only be allowed during construction hours.

  3. Construction vehicles shall not:
    • Block roads
    • Block driveways
    • Obstruct traffic
    • Damage subdivision roads

  4. Any damage caused by construction vehicles shall be repaired at the homeowner's expense.

SECTION 7. STORAGE OF MATERIALS

  1. Construction materials shall be stored only within the property boundaries.

  2. The following areas shall not be used for storage:
    • Roads
    • Sidewalks
    • Easements
    • Common Areas
    • Parks

  3. Materials shall be properly secured to prevent accidents.

 

SECTION 8. ROADS, SIDEWALKS, AND DRAINAGE PROTECTION

  1. Mixing cement, mortar, concrete, paint, grout, or similar materials on roads, sidewalks, gutters, or common areas is strictly prohibited.

  2. Contractors shall provide mixing platforms inside the property.

  3. Dumping of any material into drainage systems is prohibited.

  4. Any clogged drainage caused by construction activities shall be cleaned immediately at the homeowner's expense.

SECTION 9. CLEANLINESS AND WASTE MANAGEMENT

  1. Construction sites shall be maintained in a clean and orderly condition.

  2. Debris, soil, sand, gravel, wood, steel, and waste materials shall be regularly removed.

  3. Roads shall be cleaned daily whenever construction activities create dirt or debris.

  4. The homeowner shall be responsible for proper waste disposal.

SECTION 10. DUST, NOISE, AND NUISANCE CONTROL

  1. Contractors shall take reasonable measures to control dust.

  2. Watering of dusty areas shall be performed when necessary.

  3. Loud and unnecessary noise shall be minimized.

  4. Construction shall not unreasonably disturb neighboring residents.

SECTION 11. SAFETY REQUIREMENTS

  1. Contractors shall maintain a safe worksite.

  2. Excavations shall be barricaded.

  3. Dangerous areas shall be properly marked.

  4. Workers shall wear appropriate protective equipment.

  5. The homeowner and contractor shall be solely responsible for workplace safety.

SECTION 12. TEMPORARY FACILITIES

  1. The homeowner or contractor shall provide a temporary comfort room for workers.

  2. Workers shall not use neighboring properties or vacant lots as comfort rooms.

  3. Temporary utility connections shall comply with applicable regulations.

SECTION 13. DAMAGE TO COMMON AREAS

  1. The homeowner shall be responsible for any damage caused by:
    • Workers
    • Contractors
    • Suppliers
    • Delivery Vehicles
    • Visitors

  2. Damages may include:
    • Roads
    • Curbs
    • Sidewalks
    • Drainage Systems
    • Landscaping
    • Gates
    • Streetlights
    • Security Facilities
    • Common Areas

  3. The HOA may undertake repairs and charge the homeowner accordingly.

SECTION 14. CONSTRUCTION BOND

  1. A refundable Construction Bond of 15,000 Pesos shall be deposited with the HOA before construction begins.

  2. The bond may be used to cover:
    • Property damage
    • Road repairs
    • Drainage repairs
    • Cleanup expenses
    • Unpaid penalties
    • Administrative costs

  3. Any unused balance shall be refunded after final inspection and clearance.

SECTION 15. HOA INSPECTIONS

  1. HOA officers, authorized representatives, and security personnel may inspect the construction site at reasonable times.

  2. Failure to comply with HOA directives may result in suspension of construction activities.

SECTION 16. COMPLETION OF CONSTRUCTION

  1. Construction shall be substantially completed within the period approved by the HOA.

  2. Abandoned construction sites may be subject to HOA action.

  3. Final HOA inspection shall be required before release of the Construction Bond.

SECTION 17. HOMEOWNER LIABILITY

The homeowner shall be fully responsible for all acts, omissions, violations, damages, claims, injuries, accidents, losses, and liabilities arising from the construction project and from the conduct of contractors, workers, suppliers, visitors, and subcontractors.

SECTION 18. INDEMNITY

The homeowner agrees to indemnify and hold harmless Parkview Executive Townhomes Homeowners Association, its officers, directors, committee members, employees, security personnel, and representatives from any claim, lawsuit, injury, loss, damage, or liability arising from the construction project.

SECTION 19. VIOLATIONS AND PENALTIES

The HOA may impose:

• Written Warnings
• Administrative Penalties
• Suspension of Construction Activities
• Denial of Worker Access
• Recovery of Repair Costs
• Forfeiture of Construction Bond
• Legal Action

without prejudice to remedies available under law.

SECTION 20. ACKNOWLEDGMENT

We certify that we have read, understood, and voluntarily agree to comply with all provisions of this Construction Permit, Homeowner Undertaking, and Construction Rules and Regulations Agreement.
