Article 2 — When You Need HOA Approval

You MUST get HOA Construction Clearance if your project will:

  • Change the exterior (facade, fence, gate, roofline, windows, paint facing the street).

  • Tap/relocate utilities or drainage (water, power, telco, manholes, gutters, downspouts).

  • Use or block common areas (road, sidewalk, planting strip, pocket park).

  • Create noise, dust, or safety risks that can affect neighbors.

  • Require a city/municipal building permit under the National Building Code.

Usually NO clearance needed for small interior fixes that don’t affect the exterior/common areas and don’t need a building permit. If complaints or safety issues arise, the HOA can require clearance.
Legal basis: RA 9904 (rule-making for common areas); PD 1096 & IRR (permit triggers).
